New-Entrant Audit Checklist

The 10 things an FMCSA new-entrant safety audit checks first. Missing any of the first seven for even one driver can mean an automatic fail.

  1. Drug & alcohol testing program: you're enrolled in a DOT testing program, and every driver is in a random pool.
    49 CFR 382.305 (random testing)
  2. Pre-employment drug test: a negative result is on file for every driver before their first dispatch.
    49 CFR 382.301
  3. Medical certificate: every driver has a current medical examiner's certificate, and you keep a copy.
    49 CFR 391.41, 391.51
  4. Valid CDL: each driver's license matches the class and endorsements they actually drive.
    49 CFR 383.23, 391.11
  5. Motor vehicle record (MVR): pulled at hire and again at least every 12 months.
    49 CFR 391.23, 391.25
  6. Clearinghouse queries: a full pre-employment query, plus an annual query for every driver.
    49 CFR 382.701
  7. Driver qualification file: the driver's application, plus previous-employer safety inquiries (3 years).
    49 CFR 391.21, 391.23
  8. Annual vehicle inspection: done within the last 12 months on every truck and trailer, with documentation.
    49 CFR 396.17
  9. Driver vehicle inspection reports (DVIRs): completed and kept.
    49 CFR 396.11
  10. Insurance: proof of the required coverage is on file with FMCSA (MCS-90 / BMC-91).
